RECURRING CREDIT CARD DRAFT (EFT) AND/OR ACH AUTO-PAYMENT CONTRACT
[Purchase under our auto-billing payment constitutes your agreement as follows]: This agreement is for a multi-month electronic funds transfer contract with Yippiekiyay Nonprofit Solutions (YNS). Purchase under these terms constitutes an agreement, in consideration of goods and services rendered I/we agree to continue to have monthly fees paid through the debit card/credit card number provided (or via ACH Draft) on the completed Order Form for prearranged Payments for the period that appeared in the checkout process and in your receipt. Thereafter the contract may continue on a month-to-month basis and billed to the provided account number until I/we execute cancellation.
Seven days notification prior to the next bill date is required in order to stop the next scheduled billing. Enrollment is subject to account verification. Credit/debit card account must be in good standing.
1. Cancellation – Cancel anytime after the term agreed (2-payment, 3-payment, 12 months, or otherwise). YNS is authorized to debit the credit card account provided for a period of 12 months. Membership will continue thereafter until cancelled by customer. A cancellation notice must be received by YNS no later than 3 days before the scheduled billing date.
2. Recognition of services rendered in good faith – You acknowledge that YNS services, including the initiation and completion of filings with State and Federal government authorities, incur up-front cost and investment by YNS which is recouped over time by structured monthly payments. Further, YNS provides ongoing service and training beyond initial service as a benefit over and above the initial services rendered.
3. Insufficient funds – If your automatic withdrawal is returned for insufficient funds, YNS and your financial institution may assess a fee. If an automatic withdrawal is rejected by your financial institution for insufficient funds, we will attempt to draft it one more time, before deeming your monthly payment unpaid. If the draft is returned unpaid, you then must send your payment directly to us in the form of cash, money order, cashier’s check, or certified bank check.
4. Successors or Assigns – This Authorization agreement also extends to YNS agents, successors, and assigns.
5. YNS shall be held free and harmless from and against any and all claims, demands, actions, suits, or expenses (including reasonable attorneys’ fees), whether based on contract, negligence, or otherwise, as may arise out of any act or failure to act on the part of YNS or any agent. IN NO EVENT SHALL YNS BE LIABLE FOR ANY CONSEQUENTIAL, SPECIAL, INDIRECT, PUNITIVE OR EXEMPLARY DAMAGES OR LOSSES THAT YOU MAY INCUR OR SUFFER BY REASON OF THIS AGREEMENT OF ANY PAYMENT EFFECTED OR NOT EFFECTED UNDER THIS AGREEMENT.
BY PROCEEDING WITH THIS PURCHASE, I HEREBY ACCEPT AND AGREE TO THE TERMS AND CONDITIONS NOTED ABOVE.
Privacy
